      Economics is 90% ethics and 10% math. Plunder being the timeless grail of all governments, it's always helpful to follow the money. If you reduced the current $3,800,000,000,000 tsunami of federal revenues down to about $700 billion annually, you'd have enough to fund all lawful federal powers (those 17 powers we granted it in the Constitution, Art I Sec 8). Everything else that Washington DC does today -- the other $3,100,000,000,000 annually...is ILLEGAL.

      Think about that corruption; that is a HUGE crime cartel; the largest on earth, in monetary terms. Thus, to stop it, the citizenry must have the presence of mind and the ethical fortitude to SHUT OFF THE FUNDS. That is the ethical purpose of the 40-year-old Tax Honesty movement. It is simple ethics; simple constitutional law: stop the plunder and illegal activity through LAWFUL financial embargo.

      There are an estimated 67 million non-filers today; tens of millions of us are lawfully, consciously holding government to account, shutting off the spigot. "Household secession", you might call it. Thus, as this corrupt Congress goes a bridge too far (as they have done many times before!) we Nontaxpayers can at least smile and know that WE don't fund the criminals. We obey the Tax Code (believe it or not, it's perfectly constitutional and fine left just as it is!) and we make our IRS employees obey it also!

      Time to fight criminals with the only thing they understand: cut off their money, and then start imprisoning them.

      True FMC (as defined by Hayek, von Mises, or Rothbard) cannot be blamed for our current economic mess because it hasn't existed since the end of Andrew Jackson's presidency.

      In his 1837 farewell address, President Jackson warned us that the financial empire ("the money powers" who prowl the earth in every age) would rear its head again immediately, and under the federal jacklboots of Dishonest Abe, it did.

      The "divide and conquer" strategic plan of the global elite kept America atomised and warring with itself even after Lincoln's "shock and awe" troops were finished -- for over a century and a half now, through the donkey and elephant machines.

      Government schools keep the people ignorant, and this completes Marx's plan for America. Marx was an astute follower of Abe Lincoln; I recommend the book "Red Republicans and Lincoln's Marxists" to learn just how bad things have been since that monster was in the White House.

          John, I am no Galileo, but your image of Larry Williams CPA as a wicked high priest...that's a funny image.

          Yes, I wrote too fast; I knew and have written elsewhere that the Schulz ruling came from the 2nd Circus, not the Supremes. I know Bob Schulz and his 501c3 "chickens-lets-petition the-foxes!" show; he'd never be heard at the USSC.

          What's funny is that Larry played right along with me for two weeks now, and he has laid out all his cards for the record, for later visitors. Typical shifty lawer, laying out absolute garbage for months...making assertions that he KNOWS are complete nonsense, but he does is anyway, to impress HIMSELF.

          It's delightful!

          He makes "the big bucks", though...doing IRS work-arounds for his seedier clients, I presume? Those who really DO believe they owe a tax, but want to evade it?

          Of course, Larry Einstein CPA also knows that no one but the three of us is even following this thread. Oh, wait...except for his puppet-handler, Dan Evans (don't pull too hard, Dan; you'll choke off LarryBoy's circulation!)

          Okay, and possibly Dale Eastman is still watching along for grins. But I doubt it.

          Anyway, I just think it's funny. Larry in his pointy black hat and his baggy black cape, conjuring and sliding side to side in the old soft-shoe of the doddering High Priest.

          Tax Honesty is just a secondary issue. I haven't lost anything to IRS, or ever been harmed by them. I filed my ex parte case in 2004 in a Texas court, as a test of the thesis that federal actors who are state residents may be brought into a state court for violating state laws, just like any other Texan.

          In other words, no one is above the laws. Government employees can't do illegal things and just claim immunity.

          Full disclosure: Judge Raul Vasquez, 111th District of Texas, sidestepped his duty under Texas Government Code 51.901 by saying in effect, "this IRS employee that filed a fraudulent lien against you? She's a judicial entity; take it up with her!"

          So what did I gain by pursuing my ex parte case against the IRS actors? I learned that if you bring a clear-cut crime before one state judge alone, that wimp is more willing to call the IRS a judicial branch agency, rather than to call a federal fraudster, a fraudster.

          My experience in pursuing that ex parte action against Congress' bag-men, helped me to dig deeper into Madison's writing about the 9th and 10th Amendments; about the States' power over the federal creature. That experience led to my development of the tactical aspect of the AmericaAgain! Indictment Engine(TM), and gave tactical direction to our entire legal section.

          We now know that when you bring a bent federal actor into a state court for state crimes, you have to do it in large numbers. You can't have one engineer, pro se, in a lawyer's suit filing his own briefs and memoranda, and with no one else in the 'gallery'. You need to bring a FLEET of similar actions on the same calendar period across your state, against SEVERAL members of Congress, and PACK the courtroom.

          Justice will out, eventually. These are all but trials in the crucible of liberty and law. Mr. Madison gave us a singularly magnificent form of government, but he couldn't do everything. He didn't tell us exactly how to enforce the 9th and 10th Amendments, so we have crininals in Cogress, with criminals like Larry the CPA shilling for them in the private sector.

          Now we KNOW how to enforce those Amendments, and we're coming for the bad guys, through AmericaAgain! chapters, as they grow. It will take time; but then, it has taken 150 years to fall this far. We learn and we climb.

          While the US Supremes may have been clear that an IRS "summons" is just a piece of paper unless it has a (real, not 'tax court') court's judgment attached, in Texas the Penal Code is a great deal stronger about these IRS frauds:

          TEXAS PENAL CODE
          CHAPTER 32. FRAUD
          § 32.48. SIMULATING LEGAL PROCESS.

          "(a) A person commits an offense if the person recklessly causes to be delivered to another ***any document that simulates a summons, complaint,
          judgment, or other court process*** with the intent to:
          (1) induce payment of a claim from another person; or
          (2) cause another to:
          (A) submit to the putative authority of the document; or
          (B) take any action or refrain from taking any action in response to the document, in compliance with the document, or on the basis of the document.

          (b) Proof that the document was mailed to any person with
          the intent that it be forwarded to the intended recipient is a
          sufficient showing that the document was delivered.

          (c) It is not a defense to prosecution under this section that the simulating document: (1) states that it is not legal process; or (2) purports to have been issued or authorized by a person or entity who did not have lawful authority to issue or authorize the document.

          ***(d) If it is shown on the trial of an offense under this section that the simulating document was filed with, presented to, or delivered to a clerk of a court or an employee of a clerk of a court created or established under the constitution or laws of this
          state, there is a rebuttable presumption that the document was delivered with the intent described by Subsection (a).***
          ...
          (f) If it is shown on the trial of an offense under this section that the defendant has previously been convicted of a violation of this section, the offense is a state jail felony."

          So. If you live in Texas, and if you or your employer or client(s) have ever been harassed or defrauded by IRS in these ways, please understand that the US Supreme Court and the Penal Code of Texas give you perfectly good reason to take action against the terrorists.

          The US Supreme Court also exposes the favorite IRS terrorist tactic of frightening employers and clients of non-filers by sending them bogus (administrative, NOT judicial branch) 'summonses'. This is clearly fraud; an administrative-branch agency sending a letter, usually by certified mail with its usual black bars and bar-codes to make it extra-scary...with the word:

          SUMMONS

          ...across the top. This is an attempt to terrorise citizens into compliance, as though issued by a judge or other judicial authority.

          The US Supreme Court in Schulz v IRS (2005) shines the light on these terrorist tactics:

          "We view ourselves today as completing a task begun forty years ago and hold that, absent an effort to seek enforcement through a federal court, ***IRS summonses apply no force to taxpayers, and no consequence whatever can befall a taxpayer who refuses, ignores, or otherwise does not comply with an IRS summons*** until that summons is backed by a federal court order. "

          Larry the Wizard of Oz, CPA would have you think otherwise.

          Texas Government Code 51.901 provides clear tests for a fraudulent lien, and I have demonstrated to the Court that the NFTL filed against me meets two of the statute’s tests, either one of which alone is sufficient to prove fraud. Moreover, other laws apply to this common IRS practice of manufacturing “judgment liens” without the judiciary; Texas Property Code, Chapter 52 (‘Judgment Liens’) provides statutory requirements totally consonant with TGC 51.901:

          § 52.003. CONTENTS OF ABSTRACT. (a) An abstract of a judgment must show: (1) the names of the plaintiff and defendant; (2) the birthdate and driver's license number of the defendant, if available to the clerk or justice; (3) the number of the suit in which the judgment was rendered; (4) the defendant's address, or if the address is not shown in the suit, the nature of citation and the date and place of service of citation; (5) the date on which the judgment was rendered; (6) the amount for which the judgment was rendered and the balance due; (7) the amount of the balance due, if any, for child support arrearage; and (8) the rate of interest specified in the judgment.

          These laws are clear once they are known – but Texas county clerks are usually not aware of their legal duty under these statutes on fraudulent lien filing and judgment liens, both of which apply to this favorite IRS tactic.

          The IRS commits fraud every day in Texas. If you don't know this, you can't defend yourself against Nancy Pelosi's caviar-crew, including shysters like Larry Williams.

          In vacating and remanding a contest RE a bogus 'notice of federal tax lien', even the US Supreme Court in its ruling in Aquilino (1960) refused to make a ruling about property rights with no federal nexus:

          "This conflict should not be resolved by this Court, but by the highest court of the State of New York. We cannot say from the opinion of the Court of Appeals that it has been satisfactorily resolved. 6 We find no discussion in the court's opinion to indicate the nature of the property rights possessed by the taxpayer under state law. Nor is the application to be made of federal law clearly defined. We believe that it is in the interests of all concerned to have these questions decided by the state courts of New York."

          The US Supreme Court was not too big for its britches...but then the Larry the CPA behind the curtain has some very, VERY baggy britches!

          Larry Williams has here proven his incompetence as an attorney. I am just a lowly engineer, yet the U.S. Supreme Court (who, I promise you, knows more than Larry the CPA, who likes to "hide the ball"...er...meaning, "hide his brain") sides with me, not with Larry the CPA.

          Yes, you heard that right; the US Supreme Court sides with me; read the Tax Honesty Primer. I have corresponded with IRS for 11 years about all this; if they had half the dizzying intellect of Larry the CPA, of course, I would be in prison (where Larry belongs). But that's okay; so far the legal profession and the CPAs get Larry all to themselves (if Larry is to be believed; for all we know, he works cleaning acquariums at a pet shop, and plays lawyer on the internet).

          Anyway, the (13) IRS employees that I list on the Tax Honesty Primer -- none of them have had anything but evasion for me, over 11 years. Hardly stellar "customer service".

          Larry the CPA...sigh...what can you say? His dizzying intellect brings to mind the little Vizzini characheter in The Princess Bride. Hilarious, the way he hops from foot to foot, "Hey! What about it, boys! Blah blah blah, you STUPID!!" "Loser!!" "Tax protestor!! HAHAHAHAAAAA!!"

          In the first place, if Larry the CPA was really a lawyer, he'd know basic property law. He'd know that the area is STATE, not federal. He'd know that any matter dealing with your property is essentially a STATE matter, and that when even the federal government wants to "relieve" you of some of your physical property (land, house, etc) this is a STATE matter.

          In the matter of these "liens" that are not liens at all -- because there is no abstract of judgment yet, from any court, federal, state, or even county -- that are nonetheless filed in state records as a lien...THAT IS FRAUD IN TEXAS.

          Read the Texas Penal Code and Texas Government Code, Larry Einstein! I can't believe you're as stupid as you act, really.

          No actor -- whether state, federal, foreign, or from Alpha Centauri -- has a lien against the property of a Texan unless a contract exists and a judgment exists. Larry hasn't read the law in Texas; I have. It's in English.

          This means that Larry the CPA's latter-day-gnostic beliefs about his secret decoder ring are just theatrics. He really is a short little old guy in his baggy underpants, behind the curtain. He's "hiding the ball" all right.

          No, you guessed wrong. Six years ago, they committed fraud according to TX Govt Code 51.901c, filing an inchoate document and calling it a "lien". The Texas Property Code gives statutory minima for a choate lien: agreement between parties and an abstract of judgment from a court. Smith can't just file a purported "lien" in your county records, claiming that "Jones owes me a million bucks, so there is hereby created a lien...", which is the language used on IRS notices of 'federal tax lien'.

          It's a scam, and Congress makes it continue or Nancy Pelosi's caviar and jet fuel will be cut off, and Barney Frank's...

          (Well, we won't go there.)

          You get the picture. Most people including fiduciaries (bankers and mortgage companies) roll over and play dead for this state-sponsored terror organization masquerading as a tax collector. As far as I can tell, such fiduciaries are complicit in these crimes under Texas law, and they should be held responsible for it by those whose lives are ruined by IRS running frauds in Texas county records.

          They didn't ruin my life because I did my homework.           We The People are finished with this rape and pillage. We will now begin introducing the Congress to the long-lost 9th and 10th Amendments. If they don't get that, our state courts will bring them home and introduce them to a grand jury and to an orange jumpsuit, leg chains, and a perp walk.

          Larry claims that IRS employees living in Texas are above the law; that they aren't afraid of Texas Penal Code 32.48, or Texas Govt Code 51.901c, because if you work for IRS you can break state criminal laws at will.

          Larry is not only evil; Larry Williams CPA is a blithering idiot. I guess for me he's been a barrel of laughs this "tax season".           Yes, here's the US Supreme Court, which rulings have the SAME WEIGHT AS THE TAX CODE, according to the Internal Revenue Manual:

          "Keeping in mind the well-settled rule that the citizen is exempt
          from taxation unless the same is imposed by clear and unequivocal
          language, and that where the construction of a tax law is doubtful,
          the doubt is to be resolved in favor of those upon whom the tax is sought to
          be laid.” Spreckels Sugar Refining Co. v. McClain, 192 U.S. 297 (1904)

          “In the interpretation of statutes levying taxes it is the established rule not
          to extend their provisions, by implication, beyond the clear import of the
          language used, or to enlarge their operations so as to embrace matters not
          specifically pointed out. In case of doubt they are construed most strongly
          against the government, and in favor of the citizen.” Gould v. Gould, 245 U.S. 151 (1917)

          “In view of other settled rules of statutory construction, which teach that a law is
          presumed, in the absence of clear expression to the contrary, to operate

          Yes; this is obviously a principle of law..it is WELL-SETTLED law. So don't let Larry throw FairyTax dust in your eyes from behind the curtain. These are general principles about tax law, and principles of law are NOT overturned because any one case that is later overturned...might happen to mention such a principle!           66:1 Strict Construction of Statutes Creating Tax Liability

          "[I]t is a settled rule that tax laws are to be strictly construed against the

          meaning of a revenue statute, the doubt is resolved in favor of those taxed.
          Revenue laws are considered neither remedial statutes, nor laws founded upon any public policy, and are therefore not liberally construed.”

          So. Just as I don't bother with federal laws about bulk pesticide disposal, nuclear powerplant operation, or airline pilot training standards -- I don't fear the huge Tax Code because it is constitutional…and it doesn't apply to me.

          I reiterate: the Tax Code does make *some people* subject to an income tax. I just showed you a very long list. But I'm not on that list; likely neither are you.

          I've remained a law-abiding, happy Nontaxpayer for 11 years, although the IRS has sent me evasive non-responses and also threats over all those years. If a section of law actually existed, how long would that take to dig up? A minute or two.

          Instead, no matter how often I've asked that question of the IRS, they violate their operations manual, violate the law by engaging in extortion, and they demonstrate a pattern of willful evasion. For 11 years, they have passed the hot potato from one regional office to another like bullies in a playground...or saying "we haven't finished our research; we'll get back to you."

          Their dog ate their homework. And in two weeks, I have repeatedly done a slap-down of a blue-light terrorist, Larry the CPA. But Larry gets up to make further empty threats.

          Black’s Law Dictionary
          Legal principle *inclusio unius est exclusio alterius*:

          "where law expressly describes a particular situation to which it shall
          apply, an irrefutable inference must be drawn that what is omitted or excluded
          was intended to be omitted or excluded.”

          I just showed you many sections of the Code describing 'particular situations to which it shall apply'. I can find nothing showing that my activities are likewise taxable, so “an irrefutable inference must be drawn” by IRS that my income is not taxable unless they can show otherwise.

          This is EXACTLY what their employee manual demands, too:

          "Examiners are responsible for determining the correct tax liability as prescribed by the Internal Revenue Code. **It is imperative that examiners can identify the applicable law**, correctly interpret its meaning in light of congressional intent, and, in a fair and impartial manner, correctly apply the law based on the facts and circumstances of the case.”

          I found that 'Taxpayer' is defined in 7701(a)14 as one who is ‘subject to any internal revenue law’. The Supreme Court ruled that according to the Constitution, *everybody* can't be subject to it, so I just had to find a section or sections of the Tax Code making *some* people subject to it.

          By the way, this means **the Tax Code is constitutional**, contrary to what some 'tax protestor' theories claim.

          In my 11 years digging through Congress’ purposeful maze, I certainly have found things that make a person into a ‘taxpayer’ as defined in the Internal Revenue Code; things that apparently create taxable income:

          If I live in D.C., Guam, Puerto Rico, or the Northern Mariana Islands…If I'm involved in manufacture or sale of alcohol, tobacco, or firearms…If I'm an officer or employee of the federal government…If I operate a merchant vessel…If I'm a nonresident alien or a principal of a foreign corporation with income derived from sources within the United States…If I'm a resident alien lawfully admitted to a State of the Union, the District of Columbia, or an insular possession of the United States…

          If I entered a voluntary withholding agreement for government personnel withholding either as an ‘employee’ (3401(c)) or an ‘employer’ (3401(d)) (See 26 CFR §31.3402(p)-1)…If I’ve ever been notified by the Treasury Financial Management Service that I was responsible for administration of government personnel withholding (26 U.S.C. § 3403), or have applied for and received a Form 8655 Reporting Agent Authorization certificate…

          If I'm an officer or employee of the Treasury or any bureau of the Dept of the Treasury subject to IRS authority related to submission of collected taxes delegated by Treasury Order 150-15…If I receive items of taxable income from foreign sources, foreign mineral income, or income from foreign oil and gas extraction…

          If I receive income from a China Trade Act corporation…If I receive income from a foreign controlled corporation as fiduciary agent of the corporation…If I receive income from insurance of U.S. risks under 26 U.S.C. 953(b)(5)…If I receive taxable items of income from operation of an agreement vessel under section 607 of the Merchant Marine Act of 1936, as amended…If I receive items of income from a public works contract subject to Federal income and Social Security tax withholding…

          If I own stock in, do business with, or have anything else to do with a corporation in which the [Federal] United States of America owns stock. (See notes following 18 U.S.C. § 1001. Chapter 194, 40 Stat. 1015)…If I receive wages, remuneration, or other compensation as an officer or employee of an oceangoing vessel construed as an American employer…

          If I receive gambling winnings from the District of Columbia or insular possessions of the United States…If I receive items of income from maritime (international) trade in alcohol, tobacco or firearms…If I receive items of income from production and/or distribution of alcohol, tobacco or firearms in the District of Columbia or insular possessions of the United States… If I receive any items of income from activities taking place within an “internal revenue district” as such districts have been established under authority of 26 USC 7621 (U.S. Customs ports)… If I receive items of income from maritime (international) trade in opium, cocaine or other controlled substances.

          Wow...so many *taxable activities* that make a person ‘subject to a tax'. Okay, so there they are in specific language all over the Tax Code. But I haven't found my line of work in there anywhere. In fact, I haven't found the activities of the average American living and working in one of the 50 States.

          Well-settled law, and the Internal Revenue Manual says something about that, as you'll see in my next post.

          After the USSC rulings in Pollock over a century ago, Congress couldn’t put a universal tax on everyone, as they tried to do in 1894. The high court ruled that Congress had to obey the Constitution’s rules for uniformity and apportionment. So Congress cooked up a Byzantine, huge new Tax Code.

          I find that Congress did indeed make *SOME* people liable for income taxes. That’s the story told by professional engineer and former Idaho Rep. Phil Hart in his book detailing the racket’s birth, ca. 1909-1913.

          Just because Larry the CPA says, “I know the law, and Larry the CPA says…” this can’t create a legal duty for me to keep records, file forms, or pay Congress one cent through its terrorist arm (IRS). Only operation of law or contract can create such a duty:

          “The taxpayer must be liable for the tax. Tax liability is a condition precedent to the demand. Merely demanding payment, even repeatedly, does not cause liability.” Boathe v. Terry, 713 F.2d 1405, at 1414 (1983)

          For 11 years, I’ve asked a simple question of the IRS. After the US Supreme Court ruled the plenary language of the 1894 Revenue Act to be unconstitutional (it had said “everybody owes taxes, from any activity”) – Congress had to re-write the tax law, and they did. I find no problem with the Tax Code, and I obey it.

          Larry has made repeated libelous assertions on this thread. Yet, I do not protest taxation, nor am I anti-government. Nor have I ever held the Tax Code to be unconstitutional. Larry is an habitual liar and terrorist.

          Larry the CPA says I should “take my argument to the IRS when they start hassling” me. Of course, Larry is lying again. I’ve told him a dozen times already that for 11 years, IRS people haven’t touched a hair on my head or a dollar in my accounts. Like any vinyl siding salesman, they’ve sent plenty of hopeful invoices…but only for the first five years or so that I was a law-abiding Nontaxpayer.

          Once I showed them the many criminal acts they are committing in Texas (see Texas Penal Code 32.48 and Texas Government Code 51.901c), they have been very quiet for the past six years, except for one hopeful invoice every year or so (for old crimes’ sake!).

          Larry says that his clients pay him “the big bucks” to help them avoid taxes that the IRS would otherwise have them pay.           But a terrorist knows only one song, one dance. So let's see...Larry mentions Irwin Schiff. As I make clear on the Tax Honesty Primer site, filing false returns is simply fraudulent. Filling out and signing promissory documents for anyone (government or private agency) is stupid, if you don't know that you are required by law to do it, or have not agreed contractually to do it.

          For 11 years, my IRS employees can't show me that I'm required to do it, but I find in the Tax Code plenty of kinds of activities and domicile classes that ARE required to keep records, file things, and pay. Yet Irwin Schiff spent years selling books telling people how to file as a Taxpayer, but *to fill the form with all zeroes!* That's lying, without even needing to lie; just doing it because some old guy from Las Vegas (living with someone much younger, not his wife) told me I should do it...and send him money for showing me how!? The question is moot!

          On this, I disagree with Judge Napolitano, who thinks that repealing the 16th Amendment would make Congress into angels all of a sudden. No chance; we need to get tough on multi-trillion-dollar crime, Judge...even in Congress.

          If the Tax Code shows certain occupations, activities, and domicile classes as taxable, then it's futile to say they aren't. It's the law. If it doesn't say that any others are taxable, then the IRS has the burden to show that any particular person owes a tax, because many classes ARE specifically shown in the Code.

          That is well-settled law, and that's why I've been a very vocal Tax Honesty proponent, but unharmed by IRS, for 11 years. I don't sell theories or follow theories; I don't sell anything at all with respect to Tax Honesty. Nor do I accept donations.

          I only show others what I have found from unimpeachable sources (not CPAs with a dog in the fight) and from Texas and federal law, from US Supreme Court rulings (the IRS employees' manual say they have the same weight as the Tax Code), and from the Internal Revenue Manual.

          I don't follow theories of Tax Honesty gurus, or of Tax Dishonesty gurus like Dan Evans and Larry Williams. I don't follow theories; I obey the law, and make my IRS employees obey it, too.

          Larry doesn't like that, so you see (as I said he would) he's still spitting out his dentures, and running around with his hair on fire, bringing up everything he can for his side (the IRS goons and Larry's bosses in Congress) and conveniently forgetting there are approximately 10 MILLION non-filers running around free, for every person he just mentioned.

          I know how enamored you are of Pete Hendrickson's book, but frankly I think it's dangerous. Playing games and filing false or misleading returns with IRS is worse than foolish; it's dangerous.

          The criminal cartel in Congress needs the $4 trillion to keep coming in every year, even though Congress is legally entitled to only perhaps 25% that much, according to Article I Section 8 of the Constitution. As with any crime cartel: regardless how brazenly immoral they are in the face of law-enforcement, if they have sufficient cashflow, they can beat the good guys year in and year out.

          That's what the Congress has been doing since Dishonest Abe's administration: running every racketeering scam you can imagine. An entire library of books has been written by historians, economists, constitutional scholars, et al -- to catalogue the crimes. Andrew Napolitano's books, more than any others, have shown this to be true.

          The question is: do We The People want to actually bust the crime cartel? If so, just know that the IRS is just the petty bag-boy for the puppets in Congress.           Fact #1: “In examining the history of the debate and ratification of the 16th Amendment, this book will show that there is no evidence upon which the government can rely for their claim that the American People desired to have their wages and salaries taxed. No evidence can be found in the law journals of the time, not in the journals on political economy or economics, not in the Congressional Record nor other Congressional documents, nor in any of the newspapers of record of the time. In other words, the government’s position that wages and salaries equals income within the meaning of the 16th Amendment is ‘wholly without foundation.’” (Phil Hart, Constitutional Income: Do You Have Any? pg 10; Alpine Press, 2001).

          Fact #2: A tax on wages payable by the wage earner is a Capitation Tax. So says the premier authority on the issue, Adam Smith author of the timeless work Wealth of Nations. (Ibid. pp. 141-145)

          Fact #3: Capitation Taxes are direct taxes and are required by the Constitution to be apportioned among the 50 States. The 16th Amendment had nothing to do with Capitation Taxes. (Ibid. pp. 250 - 253.)

          Fact #4: In the few hours just prior to the Senate’s passage of the 16th Amendment the morning of July 5, 1909, the Senate twice by vote rejected two separate proposals to include direct taxes within the authority of the 16th Amendment. (Ibid. pp. 193-200.)

          Fact #5: In briefs and argument before the Supreme Court in the case of Brushaber v. Union Pacific Railroad, both Brushaber and the Government claimed that the 16th Amendment provided for a direct tax exempted from the Constitutional apportionment rule. The High Court called this claim an “erroneous assumption…wholly without foundation.” (Ibid. pp. 204-210.)

          Fact #6: Just weeks after the Brushaber Case was decided, Mr. Stanton, in the case of Stanton v. Baltic Mining Co. again claimed (35 times) that the 16th Amendment created a new class of constitutional tax, that being a direct tax exempted from the apportionment rule. The High Court said in this case that the 16th Amendment created “no new tax.” (Ibid. pp. 212-220.)

          Fact #7: In the Stanton and Brushaber Cases, the Supreme Court ruled correctly by excluding direct taxes from the 16th Amendment. The intent of the American People and that of Congress was never to directly tax the American People, but only to tax income severed from accumulated wealth. (Ibid. pp. 244 - 270.)

          Fact #8: When the Supreme Court stated in the Eisner, Stanton, and Doyle Cases that “Income may be derived from capital, or labor or from both combined” all these cases dealt with corporations and had nothing to do with the “Are wages income?” question. (Ibid. pp. 239-244, 272-274.)

          Fact #9: The genesis of the 16th Amendment was the income tax plank of the Democrat Party’s Presidential Platform of 1908 which clearly reveals the intent of that Amendment: “We favor an income tax as part of our revenue system, and we urge the submission of a constitutional amendment specifically authorizing Congress to levy and collect a tax upon individual and corporate incomes, to the end that wealth may bear its proportional share of the burdens of the federal government.” (Ibid. p. 48.)

          Fact #10: There is not, and never has been, any delegation of authority from We the People to the government for the collection of an unapportioned direct tax on the wages and salaries of the American People. It has been a maxim of English Law since the Magna Carta of 1215, that the People must consent to all taxation. “We are being taxed without our Consent!” (Ibid. p. 278.)

This is the only exhaustive primary-source analysis of the intent of the American People in supporting an income tax amendment to the Constitution.           I came on this thread six days ago. Larry Williams CPA had milked it along for 950+ posts over 9 months. I told you two other readers of this thread: LarryBoy will go on for months more, defending his indefensible career.

          Over 67 million non-filers don't believe the DC al Qaeda's terror tactics anymore. Larry and his ilk can hop around and scream at the top of their lungs (and quite childishly, you'll notice?) but Larry Williams CPA is shooting blanks. Every one of his assertions has been proven either insipid (immaterial) or illustrative of someone trying to "paper over" a bad spot in his career.

          Don't misunderstand; I don't place all CPAs in the same dark cesspool, with all those 'tax preparers' out there. Some CPAs do accounting work for Nontaxpayers as well as Taxpayers. These are the rare honest CPAs.           And speaking of delusional: after claiming "I know the law; I can tell you what the law says...Zuniga cannot!", I simply stated a FACT...that 13 employees of the IRS have been unable to answer a simple question for me in the 11 years I've been a (vocal!) law-abiding Nontaxpayer. So I have told them to go peddle their vinyl siding invoices somewhere else. They have, for 11 years now.

          Then I have referred you to Texas Penal Code (32.48) and Texas Government Code (51.901c) sections that the IRS violates all the time, every day, against Texans but those Texans don't know it, so they don't go after the perps.

          If a Texan happens to work for the IRS while committing a crime in Texas, that does NOT put that administrative employee above Texas law. That is middle-school civics, not even first-semester law. But Larry Williams CPA is aslo a self-proclaimed wizard in law as well. Mm hmmm...and he claims that *I* am the one with delusions of grandeur?

          Oh well. Larry is simply evil.

          I didn't originate the charge about the CPA profession being systemically corrupt. Mike Brewster did, in his excellent book...bottom link, below. Read it, and see 200+ pages documentation how deeply corrupt the accounting profession has become.

          (But most of us already sensed this if we've ever had to pay a CPA's invoices, just to tell us we owe more, and more, and more....)

          One in three working-age Americans is now a non-filer, yet the IRS recommends fewer than 300 people to DoJ annually, TOTAL, for white-collar crimes? Let's do the math...if we made it 670 suggested indictments per year...that's one one-thousandths of 1% rate of indictments of all these "criminals"? What is that...about 3,450 times worse indictment rate than the police force in Aguascalientes, Mexico?

          If you're still terrorised by anything having to do with the IRS, then you must educate yourself. There is nothing wrong with the Tax Code; the corrupt Congress has made sure of that. So it's Taxpayers vs. Taxspenders, and the goal is your checkbook.

          Sutherland's Rules of Statutory Construction is recognised as a core text on statutory construction by the American Bar Association. The ten-volume exhaustive resource provides all the acknowledged principles of American statutory interpretation.

          In Sutherland 66:1 entitled "Strict Construction of Statutes Creating Tax Liability", see what we find? It's precisely in line with the century of Supreme Court rulings just noted:

          "[I]t is a settled rule that tax laws are to be strictly construed against the state and in favor of the taxpayer. Where there is reasonable doubt of the meaning of a revenue statute, the doubt is resolved in favor of those taxed. Revenue laws are considered neither remedial statutes, nor laws founded upon any public policy, and are therefore not liberally construed."

          The Internal Revenue Manual -- the IRS employee's operations manual -- indicates that Larry is talking through his terrorist hat, viz:

          "4.10.7.1 Overview.
          Examiners are responsible for determining the correct tax liability as prescribed by the Internal Revenue Code. It is imperative that examiners can identify the applicable law, correctly interpret its meaning in light of congressional intent, and, in a fair and impartial manner, correctly apply the law based on the facts and circumstances of the case.

          "4.10.7.2 Researching Tax Law.
          Conclusions reached by examiners must reflect correct application of the law, regulations, court cases, revenue rulings, etc. Examiners must correctly determine the meaning of statutory provisions and not adopt strained interpretation.

          "4.10.7.2.1.1 Authority of the Internal Revenue Code.
          The Internal Revenue Code is generally binding on all courts of law. The courts give great importance to the literal language of the Code.

          I’ll cite well-settled law presently, INCLUDING the Internal Revenue Manual.

          Moreover: the Tax Code DOES make some people subject to an income tax; it DOES make some people into Taxpayers. You just read a long list! But I'm not on that list...I'm a law-abiding, happy Nontaxpayer among America’s estimated 67 million non-filers.

          Black’s Law Dictionary defines the legal principle "inclusio unius est exclusio alterius" (to include one is to exclude all others) as dictating that:

          “where law expressly describes a particular situation to which it shall apply, an irrefutable inference must be drawn that what is omitted or excluded was intended to be omitted or excluded.”

          I just showed you many sections of the Code describing 'particular situations to which it shall apply' and since I can find nothing showing that my activities are likewise taxable, “an irrefutable inference must be drawn” that my income is not taxable.

          The U.S. Supreme Court agrees, whether one of these rulings were superseded by Congress later on, the PRINCIPLE of legal interpretation remains well-settled law:

          "Keeping in mind the well-settled rule that the citizen is exempt from taxation unless the same is imposed by clear and unequivocal language, and that where the construction of a tax law is doubtful, the doubt is to be resolved in favor of those upon whom the tax is sought to be laid.” Spreckels Sugar Refining Co. v. McClain, 192 U.S. 297 (1904)

          “In the interpretation of statutes levying taxes it is the established rule not to extend their provisions, by implication, beyond the clear import of the language used, or to enlarge their operations so as to embrace matters not specifically pointed out. In case of doubt they are construed most strongly against the government, and in favor of the citizen.” Gould v. Gould, 245 U.S. 151 (1917)

          “In view of other settled rules of statutory construction, which teach that a law is presumed, in the absence of clear expression to the contrary, to operate prospectively; that, if doubt exists as to the construction of a taxing statute, the doubt should be resolved in favor of the taxpayer...” Hassett v. Welch., 303 US 303, 82 L Ed 858. (1938)

          This well-settled law demands that in determining tax liability, nothing can be presumed taxable until finding in law what is SPECIFICALLY INDICATED to be so.

          In other words, contrary to Larry’s strident assertions, if a tax agency employee wants you to pay something, THEY MUST SHOW YOU THE LAW REQUIRING IT.

          Since 'taxpayer' is defined in 7701(a)14 as one who is ‘subject to any internal revenue law’ the IRS terrorist must find a section or sections of the Tax Code making some people subject to it.

          The Supreme Court ruled in Pollock that according to the Constitution, everybody can't be subject to it. A taxing statute must be specific; cannot be an "everybody just pay!!" scheme.

          I am NOT a "tax protestor"; certain activities and categories of residency do have a liability to keep records, file forms, and pay, according to the Tax Code.

          Dear reader, that's a critical point you’ll have to repeat as often as you discuss Tax Honesty with slave-hunter terrorists like LarryBoy here. Some people are INDEED made subject to the Tax Code, but not everyone is made subject.

          Significantly, this means the Tax Code is constitutional, contrary to what some 'tax protestor' theories claim.

          I found things that make a person into a ‘taxpayer’ as defined in the Internal Revenue Code; things that apparently create taxable income. In my 11 years digging around in the Tax Code, I found a number of such activities and domicile situations:

          - If I live in D.C., Guam, Puerto Rico, or the Northern Mariana Islands;

          - If I'm involved in manufacture or sale of alcohol, tobacco, or firearms;

          - If I'm an officer or employee of the federal government;

          - If I operate a merchant vessel;

          - If I'm a nonresident alien or a principal of a foreign corporation with income derived from sources within the United States;

          - If I'm a resident alien lawfully admitted to a State of the Union, the District of Columbia, or an insular possession of the United States;

          - If I entered a voluntary withholding agreement for government personnel withholding either as an ‘employee’ (3401(c)) or an ‘employer’ (3401(d)) (See 26 CFR §31.3402(p)-1);

          - If I’ve ever been notified by the Treasury Financial Management Service that I was responsible for administration of government personnel withholding (26 U.S.C. § 3403), or have applied for and received a Form 8655 Reporting Agent Authorization certificate;

          - If I'm an officer or employee of the Treasury or any bureau of the Dept of the Treasury subject to IRS authority related to submission of collected taxes delegated by Treasury Order 150-15;

          - If I receive items of taxable income from foreign sources;

          - If I receive foreign mineral income;

          - If I receive income from foreign oil and gas extraction;

          - If I receive income from a China Trade Act corporation;

          - If I receive income from a foreign controlled corporation as fiduciary agent of the corporation;

          - If I receive income from insurance of U.S. risks under 26 U.S.C. 953(b)(5);

          - If I receive taxable items of income from operation of an agreement vessel under section 607 of the Merchant Marine Act of 1936, as amended;

          - If I receive items of income from a public works contract subject to Federal income and Social Security tax withholding;

          - If I own stock in, do business with, or have anything else to do with a corporation in which the [Federal] United States of America owns stock. (See notes following 18 U.S.C. § 1001. Chapter 194, 40 Stat. 1015);

          - If I receive wages, remuneration, or other compensation as an officer or employee of an oceangoing vessel construed as an American employer;

          - If I receive gambling winnings from the District of Columbia or insular possessions of the United States;

          - If I receive items of income from maritime (international) trade in alcohol, tobacco or firearms;

          - If I receive items of income from production and/or distribution of alcohol, tobacco or firearms in the District of Columbia or insular possessions of the United States;

          - If I receive any items of income from activities taking place within an “internal revenue district” as such districts have been established under authority of 26 USC 7621 (U.S. Customs ports);

          - If I receive items of income from maritime (international) trade in opium, cocaine or other controlled substances.

          Wow...so many taxable activities. But I haven't found my line of work in there anywhere. In fact, I haven't found the activities of the average American living and working in one of the 50 States.

          I repeatedly demanded any citation of law from IRS and my representatives in Congress, that makes me a Taxpayer as defined in law, since so many other activities ARE treated specifically in the Code.

          But year after year, I only got evasion from IRS employees. After the first few years, my terror victim conditioning finally wore off and I’ve remained a happy Nontaxpayer ever since.

          3) LarryBoy CPA goes on a long rant about my citing a US Supreme Court ruling (Gould v. Gould, 1917) and asserting that it had been overruled. That's a point I do not concede (I haven't checked yet) but which is immaterial for the contextual purpose.

          Anyone seeing that citation in the Tax Honesty Primer sees that I use that ruling, with two others from the Supreme Court...and with relevant cites from Black's Law Dictionary, Sutherland's Rules of Statutory Construction, and the Internal Revenue Manual...to show the century-long well-settled law on a PRINCIPLE of tax law INTERPRETATION, not the particulars of a case! But I think the point is lost on Larry Einstein, CPA.

          4) Larry CPA knows what the Tax Code says...fine; so did Joe Banister, CPA. After about a decade working as an IRS CID agent, Joe learned the truth about Congress' IRS scam, and was forced out of that agency. The only official Historian of the Internal Revenue Serive in that agency's history, testified before a committee of Congress years ago, that the agency was fully corrupt; destroyed records, refused to produce documents, etc. So she was fired, and the IRS has never had another historian. No mystery there at all.

          So I don't wonder why all those IRS employees would never answer my simple questions. I also don't wonder which side of the fence Larry CPA is on; he likes his CPA standing in the community and his CPA income. No problem, and he'll answer for it one day before the tribunal that counts most of all: the tribunal of Heaven.

I have exposed him and trussed him up in one weekend; I do not intend to waste more time with him. You have what you need to disabuse yourself of the Larry Williamses of America; now perform due diligence.

          Upton Sinclair said "It is difficult to get a man to understand something when his salary depends upon his not understanding it." Your CPA may refuse to discuss Tax Honesty, threatening "I'll see you in prison!". He doesn't want his professional career exposed as corrupt; THAT is why Larry has fought so long here...this is about defending himself against the reality that his life's career is illegitimate and indeed a protection racket for state-sponsored terrorism overseen by a palpably corrupt Congress.

          Besides being on the wrong side of the law, Larry Williams CPA is also on the wrong side of an ethical Rubicon in American history. Let me illustrate.

          Imagine that your mother was dragged here in chains from Africa; that you were born on a plantation in 1799; that you escaped, and that a fellow with the moral compass of Larry Williams (a paid slave-hunter) caught up with you.

          Now if you read the Tax Honesty Primer you will see why there are 67 million non-filers in America; the law DOES establish a duty to file and pay taxes for dozens of lines of work...but for most of us, IT DOES NOT. So the IRS captures eight filers for every non-filer; yet there are only twice as many filers as non-filers. So apparently a filer is 4 times more likely to be chased by the IRS than a non-filer, all else being equal. The slave-hunters go after filers, in onther words; they want you back on the plantation.

          Although I find the law to be clearly on the side of Tax Honesty, let's set aside the law for a moment, and consider the ethical implication of the favorite CPA taunt to law-abiding Nontaxpayers: "Judges will rule against you!"

          For two reasons, that is an immoral assertion:

          1) The IRS is statistically 4 times more likely to pursue a filer than a non-filer, so the assertion is mendacious;

          2) The slave-hunter (CPA) knows that even if the law was on his side, allowing him to return the slave to the plantation using threats of violence and prison (as slave hunters always did, and do)...the slave-hunter's career is still a monstrous activity.

          The tide of history caught up with chattel slavery, as it caught up with the monstrous judges in Hitler's Third Reich, who used to rule that a runaway Jew was in the wrong, and had to be returned, by law, to the concentration camp.

          Wickedness cannot stand forever; truth will out. In the matter of Congress' IRS scam; the largest, longest-running financial scam in modern history -- 67 million of us are off the plantation, and we do not intend to go back. In fact, we've done our homework, and the law is even on OUR side!

          Thus, before you believe the empty taunts of the slave-hunter CPA, note that the chains in his hand are shaking. He knows that his days are numbered, and that he is on the side of wickedness, not law. The more and louder he protests, the more you should search the law, and look to the open road in front of you.

          Truth CAN be known; but the first step you take must be spiritual, not intellectual. You must decide whether this time, America will allow slavery to continue, despite the clear lessons of history, and the clear words of the law.

          Peter Hendrickson was the IRS trophy for this Tax Terror Season. Congress makes them dig up about one or two a year: Leona Helmsley, Willie Nelson, Wesley Snipes, or some fellow holed up in an underground compound. It always has to be someone that the average juror would simply never associate with: applying for a multi-million-dollar REFUND? No way will the average envious person let that defendant go.

          As I said, Pete Hendrickson seems foolish, to tell people that for $20 he'll take you back into the dark alley where you get beat up every payday so they can get a refund from the thugs! Yet the fact remains: IRS indicts EIGHT TIMES MORE FILERS every year than non-filers, yet filers (115 million) only outnumber non-filers (67 million) about two-to-one.

          Thus, regardless whatever self-serving terror threats Larry might make on these threads, he is a CPA; his career is tied to IRS' success at keeping you terrorised enough to run to him for 'protection'. Not only are the statistics terribly against his 'profession' now, but I wouldn't be too proud of being part of a protection racket. It's immoral.

          Well, no surprise THERE. I just backtracked a few months(!!) on this thread, to learn that Larry Williams is a CPA.

          If Tax Honesty goes to scale, it will bust Congress' IRS scam, and Larry's career is over. Obviously, he must thrash in these waters for as many months as he can, to beat back "johnthetaxist", thus retaining the public perception of 'tax professionals' as really trying to 'help you', rather than hold you down while IRS does bad things to you.

          Most people already see through the accounting 'profession' as those guys with the green visors who cook books for a living. But the whole tax industry (including tax attorneys) are in the muck in most people's eyes.

          As far back as Shakespeare's Dick the Butcher, whose famous line was, "first thing let's do, let's kill all the lawyers!" -- the legal 'profession' is hardly the public's idea of moral probity.           Parasites like Larry must keep Taxpayers in terror and in line, so as to continue living off the productive work of others, while maintaining the preposterous air of superiority shared by the playground bully and the Colombian drug lord.

          Go back and review just a few dozen of Larry's posts on this thread. He exposes himself as precisely that sort of shameless, mendacious hustler of the kindergarten playground. His churlish jabs at others on this thread emote a line from Hamlet,

          The tombstone of a civilisation can be laid at that point where truth is no longer defended, because it cannot be known. But you see, truth CAN be known; in the matter of Congress' IRS scam, the tide of history is catching up with those crooks. As of 2005, by a former IRS spokesperson's estimate, there were already an estimated 67 million
          non-filers; that number is much higher today. You will NOT hear this in the mainstream media, or from your complicit parasite (tax preparer, CPA, pastor, investment counselor, etc).

          Tell the truth, obey the law, and make your federal employees do the same. And by all means, don't fear petty terrorists posing as your employees, or trolling internet forums kicking sand in your face to keep you in the "fair share" line.

                New Hampshire is a gorgeous place, filled with REAL Americans who desire liberty or death. That's all good.

                What is NOT good is repeating historical folly; that's what single-state secession is. Like nullification, this goes against the principle that ALL of us citizens are the apex sovereigns over the Constitution; the federal government is our creature, not master.

                When the sovereigns tuck tail and run, the creature-cum-master has an easy time going after the fleeing target. Human nature being what it is, the people of other states who are 'stuck in America' will only be envious. New Hampshire will decline in popularity, and the more socialist citizens in all the other states will turn on the 'free' ones.

                I'm a proud, unreconstructed Texan. Our state was a republic once, and we are larger than most of the nations of the world. Yet I think even Texas secession is a fool's errand. The much better solution to this constitutional crisis (now almost 150 years old) is to turn our domestic enemy's divide-and-conquer tactic right back on them.

                By 'them', I mean those who have controlled Congress from behind the scenes for 175 years, always by dividing the American people against one another. Now it's time to use the same shrewd tactic to give teeth to the 9th and 10th Amendments, at last:

The basic tactical principle (ironically) is Alexander Hamilton's; see his Federalist #28, about the combined power of the People and the States vs. our federal creature when it slips its leash.

                It's not like New Hampshire folks to cut and run from any threat; nor is it like a Texan, at all. Yet folks from my state and yours still want to let them divide us and conquer us even more.                     The federal government currently spends more than FOUR TIMES what it should be receiving, to fund the enumerated powers in Art I, Sec 8 of the Constitution. For every legal power it exercises, it's exercising FOUR illegal ones.

                    Nothing personal, Don. But your plan is even worse than the "revenue neutral" FairyTax plan, that would let the criminally insane teenager keep the red Ferrari, the no-limit credit cards, and the $1,500-per-week allowance while he beats you every night, and rapes the neighbor's daughter too.

                    If we want to bring the D.C. Leviathan back to its lawful powers and out of our lives like every other fascist or socialist system in history...then we have to TURN OFF the spigot.                       Texas is the freest, by a wide margin, all things considered.                       There are pockets of bureaucratic armageddon, of course. You don't want to live in Austin or Travis County. It's liberal (old hippies and sexual deviants of all ages) and it's a regulatory morass (government bureaucrats in everything).

                      Like most big cities on earth, Texas' big cities are a tough place to live if you like liberty. But once away from major metro areas, Texas can't be beat. It's larger than most European countries, so there's still room to roam when you need it.

                            John Linder has tried to push the FairyTax Trojan horse into America's camp for 11 years, always failing. For the (17) enumerated (i.e. lawful) powers that we granted to federal government in the Constitution, Congress should receive $450-700 billion annually (depending on whose vision of a world military you prefer). Yet it's shoveling in almost FOUR TRILLION per year.

                            Do the math: the federal government is engaging in four times as many illegal acts and projects, as legal ones. The corrupting equivalent of 11,000 major drug cartels operating inside the DC beltway.

                            Neal Boortz, an avowed atheist, is a fitting spokesman for Congress' Trojan horse, the 'FairyTax'; the Tea Party movement seems enthralled with the idea of "getting rid of the IRS"...not realizing that every retailer in America will BECOME the IRS under this evil plan. European history is rife with historical lessons about value-added- and national sales taxes. But we have even BETTER historical examples: King George III was exacting a national sales tax on us when we waged our War for Independence.

                            And that tax was nothing like the 30-45% tax that the Tax Fairy will be dropping on us all, if the FairyTax ever sees the light of day.

                                No member of Congress, as corrupt as it has been for 150+ years, can ever change history's trajectory now. It is up to the States and the People, giving real teeth to the 9th and 10th Amendments for the first time in 220 years. No matter how great a statesman (witness Ron Paul's uphill battle in the snake-pit for decades), dropping fresh faces into a sea of sh!7 won't end the corruption.

                                Better to split them up, bring them home, and force them to face civil and criminal charges under many STATE statutes that also happen to reflect their violations of the U.S. Constitution.                                   Bob, that is a difference without a distinction. Congress first committed and then has acquiesced in further commission of, high crimes under color of law for 97 years under the illegal 'Federal Reserve Act'.

                                  The fact that a crime continues for 97 years, for a total heist well over 100 trillion dollars, does not make it any less a high crime today than when it was first committed. We The People (or we the States, however you'd like to frame the parties to the Constitution, the supreme LAW) only gave CONGRESS power to "coin money", and only gave to Congress the power to COIN money. Anything else is illegal.

                                  Thus, every member of Congress today -- including those who call for auditing the Fed, tantamount to auditing Colombia's Medellin Cartel -- is complicit; is acquiescing in commission of the most massive financial crime in history.                                   "We" did not "decide to ignore the warnings of the founders and print paper money anyway".                                   You make the preposterous assertion that the criminal Congress "found it easier to consolidate the power of the people within a federally-chartered corporation". No, sir; the law does not allow Congress to violate it, even to grant illegal concessions to state- or federally-chartered corporations...nor to individuals, partnerships, or the man in the moon.

                                  I don't give a frog's quivering thigh WHO they grant illegal concessions to, or how long they have continued a racketeering scheme -- there is no statute of limitations on federal crimes (that have state equivalents, too), and each member of Congress that refuses to stop this RICO scam, is criminally indictable in his/her own state, under those state statutes. When entrusted with the currency, every member of Congress has a duty not to acquiesce in counterfeiting crimes instead, or to act dumb about it. Ignorance of the Constitution is no excuse for a member of Congress.

                                      Congress will regulate and tax EVERYTHING that it can; it will bring in all the trillions it can, and grease palms in your school district, city, county, and state.                                         Yes, Larry; it's appropriate that Congress' "IRS trophy" for this Tax Terror Season should be sentenced on what you CPAs call "tax day".

                                        It's also appropriate (since your 'profession' is charged with holding the Taxpayer down while the IRS does wicked things to them) that you should gloat about Mr. Henderson's sentencing.

                                        The fact is, most Americans are ignorant of the Congress' 97-year-old tax terrorism racket. You can learn exactly how Congress pulled this heist in 1913, by reading former Idaho Rep. Phil Hart's book. Mr. Hart is a registered professional engineer, and an honest man.

                                        In that little $20 book, now in its 3rd edition, the reader will see in great detail (with facsimile copies of primary sources, and copious additional documentation of secondary sources) exacxtly how the corrupt Congress did the dirty, ca. 1909-1913.

                                        Like Phil Hart, I'm also a registered professional engineer. Many of us engineers are prone to exhaustive forensic research when something is of great importance or interest. The professional engineers' Code of Ethics demands moral probity; apparently the CPA 'profession' does not. In any case, you see the problem for a CPA career, if Tax Honesty frees the citizen from Congress' wicked "fair share line".

                                        Read Mike Brewster's excellent expose of Larry's profession, in his book: "Unaccountable: How the Accounting Profession Forfeited a Public Trust".

                                        But do you want to move from playing defense against criminals in D.C.; to start playing OFFENSE as is our duty to enforce the Constitution? If so, join AmericaAgain!

                                        Let's begin putting the black hats on the crooks, instead of putting them on Taxpayers who are trying to make ends meet while Congress lives like crowned heads of Europe and rapes them raw.

                                        Stop being cowed by criminals in Congress who make Bernie Madoff look like Mother Teresa. Nor should you be terrorised by parasites who on these threads exhibit a dogged determination to keep you in fear yet are unable to back up their claims. All they can do is keep repeating: "See? One of you has been convicted and will soon be sentenced, citizen!! Beware; this could be YOU!!" This is plain terrorism, in defense of one's 'professional' career income.

                                        Congress always expects IRS to put at least one high-profile Tax Honesty trophy on the hood of their truck to drive it around town during Tax Terror Season. Keep the citizens afraid: "This could be YOU!"

                                        But there exist (at least) four problems for Congress' 97-year-old racket, and the huge parasite tax industry that keeps it rolling:

                                        1) the internet is increasingly informing citizens of the provenance, nature, and depth of the Congress' financial crime; those who learn the facts, are walking away;

                                        2) of the estimated 67 million non-filers, fewer than 100 are convicted each year. Either the parasitic tax industry is lying through their teeth...or the U.S. Dept of Justice has less than 1% as much success at convicting criminals as the police in Tijuana, Mexico;

                                        3) the IRS recommends about 800% more filers than non-filers for indictment each year; yet there are about 115 million filer and 67 million non-filers...do the math...filers are four times more statistically likely to be indicted by the IRS than non-filers.

                                        4) Congress' check-skimming scam is now exposed, the internet has a long memory, and the Tax Code is perfectly good law. Thus, We The People can obey the Tax Code and force the IRS to obey it, also. Not good for Congress' scam, I assure you; nor is it good news for the terrorist, parasitic, fraudulent* tax industry.

                                        Any honest CPA can still find gainful employment; some of them do accounting for their Nontaxpayer clients as well as Taxpayers. But they are a tiny minority in the 'profession', and not generally well-liked by the more rapacious, less ethical types.

                                        Tough toenails. This is war for America's future, and with the grace of God, We The People mean to WIN it. We think that 150 years is too long to be passive captives of a government now more corrupt than any other on earth in terms of financial loss, or loss of lives worldwide...and as captives of 'professions' that do absolutely nothing productive for a living.

                                          A: Begin to ENFORCE it, for goodness' sakes.

                                          No, not through single-state nullification; that's an invitation to state or regional atomization of the republic, inviting a draconian, tyrannical federal reaction with no nationwide counterthreat by We The People.

                                          And certainly not Bob Schulz's "petition for redress of grievances". We already have years of petitions, demonstrations, and remonstrances to absolutely no effect. Those who are of the criminal mind in Congress have absolutely no motivation to reform their criminal habits.

                                          And they are very OLD habits, I might add; the Congress' IRS check-skimming scam and its evil twin, granting a counterfeiting concession to a private banking cartel (the Fed) -- that's a 97 YEAR OLD racketeering scandal. The best that the real 'fighters' in Congress can do? Calling for an AUDIT of the scams?

                                          This is like calling for an audit of the Colombian Medellin Cartel. Please, spare me; this is NOT what Madison and Jefferson meant, when they said that We The People, through our sovereign States, had the DUTY to "judge of these infractions, and apply remedies"!

                                          AmericaAgain! is the answer. It is multi-pronged, tactical enforcement of the 9th and 10th Amendments, by splitting up Congress, bringing the individual operatives home to face STATE CRIMINAL STATUTES that happen to fit the crimes that Congress has collectively committed for a century.

                                          We The People, through our State Courts (not on our own as vigilantes) assure that the rule of law applies to those feckless perverts in Congress, just as laws apply to us. We make sure that they get something between what Martha Stewart received at Congress' hands...and maybe some of them get a sentence as tough as Bernie Madoff received, for they are MUCH worse criminals, in every way.

                                          And then, we draft, refine, and force through OUR reform legislation -- short (no law being more than 2-10 pages) and easily understood by the people.

                                          We also take Tax Honesty to scale -- from the present estimated 67 million non-filers, to perhaps twice as many; and we specifically keep the 'FairTax' "revenue neutral" Trojan horse out of our camp. The powers enumerated to federal government don;t even total $800 billion per year...yet the Taxspenders are skimming $3.7 TRILLION a year off the Taxpayers!!?

                                          This isn't rocket science. It's like asking "How can I get my 19-year-old to stop being such a spoiled brat? He beats me almost every day; he leaves his dirty clothes all over the house; he refuses to wipe himself after going potty. We gave him a new Ferrari, two unlimited credit cards, and an average of $1200 cash every Friday! What more can we do to enforce the law in our home??"

                                          Duh.

                                          AmericaAgain! is being designed as a private, perennial charitable trust with a permanent campus meant to last as long as the Constitution does. We're planning to teach citizens to ENFORCE their Constitution for the rest of American history.

                                          We intend to see corrupt gangsters in Congress, thrown in their State Penitentiary and stripped of family assets, just as Madoff was last year; their crimes are FAR worse. They have for too long danced to the tune of equally corrupt major industries, who have been writing their "laws" for a century. Now WE will write the laws, and we'll make them short so they'll actually READ them before voting on them!

                                          THAT is the AmericaAgain! strategic plan. Law enforcement has never been an easy field, yet no law is more in need of long-overdue enforcement than our Supreme Law. So join us, and roll up your sleeves.

                                          Oh...and while you're at it...vote for Judge Napolitano to become the AmericaAgain! Chief Counsel. There is no individual whose background and demeanor better suits him for this task: to forge American history in our day, and make a new way of life for citizens: the end of politics, and the beginning of informed self-government.

                                            Auditing a multi-trillion-dollar counterfeiting consortium? That's like auditing the mafia; like auditing a Mexican drug cartel.
